Appearing in court during the time of COVID-19

As a result of COVID-19, McHenry County court access is currently limited to essential cases. The courts changed operations in response to COVID-19 when court reopens.

The following directives are adapted from the McHenry County Sheriff’s Department recommendations and the court’s administrative orders.

> Make sure you need to appear. Many court appearances are being held remotely.  

If you meet any of the following, contact your attorney to discuss whether to appear:
• Flu-like symptoms including fever, cough or shortness of breath;
• Been diagnosed with COVID 19 (or someone close to you has);
• Been directed to quarantine, isolate or self-monitor at home by any medical provider;
• Traveled, within the last 21 days, to any country designated by the CDC as a high-risk locations for COVID-19; or
• Had close contact with anyone who has traveled to any of these high risk locations.

> Bring only essentials: Keys, photo id; cash/credit cards, court papers.

> Bring a face covering, which may be a scarf or bandanna, face mask or similar covering. 

> You cannot bring purses, backpacks, computers or briefcases to court.

> Wear little or no jewelry.  

> Water fountains may not be operable. 

> Steel toed or shanked shoes make entry to the courthouse difficult.

> There is limited to no seating in the courthouse. Do not try to enter the building more than 15 minutes before your set time. If you are early, wait in your car.

> Adults not involved in proceedings will not be allowed into the building, so do not bring family, significant others or moral support unless they will be witnesses.

> While in the courtrooms, practice social distancing.

When appearing in court, some practical protocols are:

Do not plan on having lengthy conversations with your attorney while in court.  

Plan ahead. If something needs to be discussed, raise it a couple of days before the court appearance.

After court, discuss additional issues or get further direction about the court appearance by email, text or telephone call while the attorney is not in court.

Provide important papers to your attorney at least 24 business hours (48 is better) in advance of your court appearance. You might not be allowed to bring papers to court.  


General COVID-19 recommendations applicable to court proceedings.

Continue to practice social distancing. Continue cleanliness protocols like washing your hands and using hand sanitizer. 

Carry hand sanitizer and use it when entering and leaving businesses or public spaces.

Focus on not touching your face. 

Use the bathroom before leaving home to prevent having to use public restrooms.
In-and-out is best.
